Constitutional complaint rendered moot by administrative court annulment: discontinuance and cost allocation under §19 and §88 VerfGG
Legislator-Zusammenfassung
KI-generiertThe Austrian Constitutional Court (VfGH) discontinued the proceedings and denied a claim for costs, as the administrative court (VwGH) had already annulled the challenged administrative act on the merits, rendering the constitutional complaint moot. The dispute concerned a constitutional challenge to an administrative decision, which became superfluous after the lower administrative court found the act unlawful and issued a final ruling. The court's decisive legal basis was Article 19(3)(3) of the Constitutional Jurisdiction Act (VerfGG 1953), which mandates the discontinuance of proceedings when the subject matter ceases to exist, and Article 88 in conjunction with Article 27 of the same Act, which precludes cost reimbursement to the petitioner because the case was not concluded by a withdrawal of the claim by a party but by the administrative court's annulment.
Legislator-Regeste
KI-generiert§ 19 Abs 3 Z 3 VerfGG 1953; If the Administrative Court revokes the contested administrative decision, the subject matter of the constitutional complaint ceases to exist, necessitating the dismissal of the proceedings.

Begründung:
1. Der VwGH hat mit Erk. vom 12. Dezember 1985, Zlen.
VfGH 14. Juni 1982 B75/80; VfSlg. 10548/1985).
