Legislator-Zusammenfassung

KI-generiert

The Constitutional Court dismissed the proceedings as moot and ordered the Federal Ministry of Science and Research to pay the complainant €12,100 in procedural costs within 14 days. The case involved a constitutional complaint challenging a university senate decision that had rejected the recognition (nostrification) of an foreign "Master of Arts" degree; however, before the court reached a merits decision, the administrative authority revoked the challenged decision, thereby achieving the object of the complaint. Relying on § 86 of the Constitutional Court Act 1953, the court determined that the revocation rendered the complaint moot, resulting in a termination of proceedings. The cost award was grounded in § 88 of the Constitutional Court Act 1953, and the decision was rendered without a public hearing pursuant to § 19 (3) no. 3 of the same Act.
