Legislator-Zusammenfassung

KI-generiert

The Constitutional Court ordered the complainant to reimburse 1,573 Austrian Schillings in procedural costs to the respondent company within 14 days, effective immediately. The dispute concerned a constitutional complaint that was withdrawn by the complaining party after the Court had previously dismissed the treatment of the complaint by the remaining co-complainants. Relying on Section 88 of the Austrian Constitutional Court Act (VerfGG), which mandates cost recovery for the withdrawing party, the Court allocated a pro-rata share of the legal writing costs to the complainant, noting that costs are not recoverable where the Court merely declines to process a complaint. The decision was rendered without further procedure in a non-public session pursuant to Section 19(4)(2) of the Act.

Volltext
