Legislator-Zusammenfassung

KI-generiert

The Austrian Constitutional Court denied the applicant's petition for legal aid, effectively dismissing the request and leaving the applicant without state-funded representation for the intended proceedings. The dispute concerned a procedural request for legal assistance to file applications for the reopening (*Wiederaufnahme*) of both criminal and administrative court proceedings before the Constitutional Court. The decisive legal basis was the holding that the Constitutional Court lacks jurisdiction to decide on motions for the reopening of judicial or administrative proceedings, rendering the intended litigation manifestly hopeless (*offenkundig aussichtslos*), with the decision issued without a further hearing pursuant to §72 Code of Civil Procedure in conjunction with §35(1) of the 1953 Constitutional Court Act.

2. Dieser Beschluß konnte gemäß §72 ZPO iVm §35 Abs1 VerfGG 1953 ohne weiteres Verfahren in nichtöffentlicher Sitzung gefaßt werden.
