Legislator-Zusammenfassung

KI-generiert

The Constitutional Court dismissed the application for legal aid, rejected the constitutional complaint as inadmissible, and ordered no costs to be awarded. The dispute concerned a police authority's refusal to process a residential registration submitted via post, with the complainant challenging the return of the documents as an administrative decision. The court held that even if the act qualified as a decree, the mandatory administrative appeal under the Registration Act had not been exhausted, rendering the complaint inadmissible under the Austrian Federal Constitutional Law. Consequently, the court found itself plainly incompetent to review the matter, declined to address the substantive legality of the provisions due to lack of prejudiciality, and denied costs because legal representation by the public prosecutor was deemed unnecessary.

1.a) Der Beschwerdeführer übermittelte am 23.
