Constitutional review of traffic regulation penalties: rejection due to lack of constitutional relevance and established case law on norm validity
Legislator-Zusammenfassung
KI-generiertThe Constitutional Court refused to hear the constitutional complaint and abated it to the Administrative Court for a final decision. The applicant challenged an administrative penalty, alleging violations of constitutionally guaranteed rights due to the allegedly unlawful application of federal traffic regulations regarding vehicle registration. The Court held that the complaint lacked sufficient prospects of success because the asserted grievances primarily resulted from an incorrect application of ordinary law rather than requiring specific constitutional analysis, and the claim regarding the illegality of the general administrative norms was rendered unlikely by prior case law. Consequently, based on Article 144(2) and (3) of the Federal Constitutional Law, the Court determined that no clarification of a constitutional question was to be expected from the decision, thereby delegating the matter to the ordinary administrative courts for review.
