Denial of legal aid for constitutional complaint against administrative court decision due to lack of jurisdiction and futility
Legislator-Zusammenfassung
KI-generiertThe Constitutional Court dismissed the application for legal aid to lodge a constitutional complaint, ruling that the request was unfounded and denied the applicant's request. The dispute involved an applicant seeking procedural assistance to challenge a prior decision by the Administrative Court, which had been rendered ineffective or unchallengeable through this specific channel. The decisive legal basis was the absence of any federal constitutional provision granting the Constitutional Court jurisdiction to hear a complaint against the specific type of Administrative Court decision at issue, rendering any potential complaint inadmissible due to obvious lack of jurisdiction under § 19 Abs. 3 lit. a of the Constitutional Court Act, and consequently failing the "prospect of success" requirement for legal aid under § 63 Abs. 1 of the Civil Procedure Code in conjunction with § 35 Abs. 1 of the Constitutional Court Act.

a b g e w i e s e n.
§35 Abs1 VfGG).
