Legislator-Zusammenfassung

KI-generiert

The Constitutional Court dismissed the petitioner's application for lack of jurisdiction, ruling that the request to address the constitutional status of custody proceedings failed. The petitioner, having filed an individual application, sought the Court to concretize constitutional guarantees regarding the observance of the European Convention on Human Rights and UN resolutions in custody cases, alleging that lower courts consistently violated these standards due to ambiguous constitutional provisions granting judges broad discretion. The Court held that Article 140 of the Federal Constitutional Law and other statutes do not empower the Constitutional Court to review the specific subject matter raised or to instruct the legislative bodies as requested, leading to a rejection of the case based on the Court's manifest lack of competence. The decision was rendered without a public hearing pursuant to the procedural provisions of the Constitutional Court Act.

Der Antrag wird zurückgewiesen.

Begründung:

3. Dies konnte gemäß §19 Abs3 Z2 lita VfGG ohne weiteres Verfahren in nichtöffentlicher Sitzung beschlossen werden.
