Asylum and foreign status complaint dismissal under §§ 52, 46, 55 FPG 2005 with revision inadmissibility per Art. 133 Abs. 4 B-VG
Legislator-Zusammenfassung
KI-generiertThe Bundesverwaltungsgericht dismissed the appellant’s complaint as unfounded and declared the revision inadmissible, thereby upholding the decision of the Federal Office for Immigration and Asylum and leaving the original administrative act in force. The dispute centered on the appellant’s challenge to a status decision regarding asylum and foreign affairs, following a preliminary review by the administrative authority and a subsequent oral hearing before the court. The court’s decision was grounded in the statutory framework for administrative litigation and immigration proceedings, specifically applying § 57 of the Asylum Act 2005, §§ 52(2)(2) and (9), 46, and 55 of the Foreigners Act 2005, and § 9 of the Federal Office for Immigration and Asylum Act, which collectively govern the review of such complaints and the requirements for admitting a revision to the Administrative Court.
